Criminal Bar Considering “No Returns” Policy

Further to a decision by the Criminal Bar Association not to accept any new legal aid criminal work from 1 April 2018, it is understood that they are now considering a “No Returns” Policy, which was last adopted in 2015 and would mean Counsel refusing to accept cases returned by colleagues where there is a diary clash. This suggestion comes against growing concerns amongst legal aid solicitors and barristers regarding the government’s Graduated Fee Scheme, which has been in force since 1 April 2018.
